4122.  Tanzania: IHEU protests New Homophobic Law in Zanzibar-Submitted by Gogineni 8/24/04 (Sexual Minorities & HIV Status)
<br><br>Muslim-majority Zanzibar - an island nation and an important tourist destination on the East African coast - is the latest country to demonstrate homophobia. Zanzibar's President has given his assent to a Bill passed unanimously by the Zanzibar Parliament. The new law imposes a 25 year prison sentence for men indulging in homosexual acts and 7 years for lesbian acts.<br><br> IHEU regrets the homophobia sweeping the African continent, and calls upon governments and international Human Rights institutions to take note of the serious violation of the individual's right to retain his or her sexual identity and orientation. Homosexual men and women are amongst the most vulnerable groups in Africa. They face immense social prejudice and government harassment.

Sin embargo la Comisin de Relaciones Exteriores del Congreso de Per plantea reservas en este aspecto, es decir, se opone a los derechos de las personas lesbianas, trans, gays y bisexuales.

Movimiento de Integración y Liberación Homosexual aseguró que proyecto que se presentará mañana cuenta con el respaldo de diversos parlamentarios. Con el patrocinio de diversos parlamentarios y el respaldo de la Federación Chilena de la Diversidad Sexual (Fedisech), el Movimiento de Integración y Liberación Homosexual (Movilh) ingresaré este miércoles 12 de diciembre al Congreso Nacional un proyecto de ley que deroga el artículo 373 del Código Penal, el cual sanciona las ofensas al pudor, la moral y las buenas costumbres.<br><br> Dicho trabajo, que es parte del proyecto, ?demostró que las policías aplican arbitrariamente la norma para detener, agredir, torturar y hostigar a diversos sectores sociales, como los jóvenes, las minorías sexuales y los inmigrantes?.

4126.  Dubai Court Sentences Two in Rape- The New York Times 12/13/07 (Sexual Minorities & HIV Status)
A Dubai court sentenced two men on Wednesday to 15 years in prison for the rape of a French-Swiss teenager whose case became a rallying point for critics of the way the United Arab Emirates treats victims of sexual assault.<br><br> When the teenager, Alexandre Robert, 15, first reported that he had been gang-raped by three men in July, the authorities discouraged him from pressing charges and raised the possibility of charging him with criminal homosexual activity, his family said. And Dubai authorities did not tell the victim?s family for more than a month after the attack that one of the assailants had tested positive for H.I.V. while in prison earlier.

Su acusadora es María Magdalena Salgado Contreras, quien también se desempeña como jefa del departamento de educación especial en Toluca.

4128.  Morocco: Overturn Verdicts for Homosexual Conduct- HRW 12/12/07 (Sexual Minorities & HIV Status)
(New York, December 12, 2007) ? The criminal verdicts in Morocco against six men sentenced to prison for homosexual conduct should be set aside and the men released, Human Rights Watch said today.<br><br> The court of first instance in Ksar el-Kbir, a small city about 120 kilometers south of Tangiers, convicted the men on December 10 of violating article 489 of Morocco?s penal code, which criminalizes ?lewd or unnatural acts with an individual of the same sex.? According to lawyers for the defendants, the prosecution failed to present any evidence that the men actually had engaged in the prohibited conduct in the first place. <br><br> ?These men are behind bars for private acts between consenting adults that no government has any business criminalizing in the first place,? said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch. ?The men?s rights to privacy and freedom of expression have been violated, and the court has convicted them without apparent evidence; they should be set free.?

SUMMARY<br><br> The Peruvian Congress is debating joining the Ibero-American Convention on the Rights of Youth (Spain, 2005) that seeks to promote and safeguard the rights of young people. The Convention also seeks to remedy the inequality that thousands of young people confront for a variety of reasons, including for having a sexual orientation different from heterosexuality. But the Foreign Relations Committee of the Congress of Peru has raised concerns in this respect, and opposes the rights of lesbian, gay, bisexual and transgender (LGBT) people.

4131.  Challenging Stigma and Discrimination in Mexico HIV/AIDS Alliance.org 1/16/06 (Sexual Minorities & HIV Status)
HIV/AIDS Alliance-Supporting community action on AIDS in developing countries. Men who have sex with men are frequently discriminated against in the family, with male family members often finding them more difficult to accept. So these men are often supported emotionally by friends rather than family. This points to the relevance of working on family and social networks linked to these populations. Many people living with HIV/AIDS testify to violations of their human rights in terms of unfair dismissal from work and mistreatment by health service providers. Most lose their jobs when employers learn of their status. And public hospitals offer an appalling level of service, partly out of ignorance but also because of a lack of specialized medical personnel. It is also common for health workers to violate clients? confidentiality.

A 21-year-old man was hanged in Iran's Kermanshah Central Prison on"anal rape" (ighab) charges Dec. 5 despite a November order from the nation's chief justice, Ayatollah Syed Mahmoud Hashemi Shahroudi, that stayed the execution and sent the case for a retrial.<br><br> Shahroudi had determined that Makvan Mouloodzadeh's sentence violated Islamic teaching, decrees of senior Shiite clerics and Iranian law, after Mouloodzadeh's lawyer argued that there was no evidence of the alleged crimes and that several elements of the case violated proper procedure.

Thirteen gays and lesbians were arrested in Moscow Dec. 1 as they were voting at a polling place. <br><br> The activists, including lead Pride organizers Nikolai Alekseev and Nikolai Baev, were later charged with staging an illegal demonstration. <br><br> The detentions were an apparent response to a call by activists for gays to write "No to homophobes!" on their ballots.

ILGA and Behind the Mask, a Website on gay and lesbian issues in Africa, cite The Pink Book, which states that Article 230 also applies to women (ILGA 31 July 2000; Behind the Mask n.d.). The Universités d'Eté Euroméditerranéennes des Homosexualités (UEEH), quoting a presentation by Amnesty International, points out that the word "sodomy," as used in Article 230, refers to any homosexual act (UEEH n.d.).
