Discrimination, Societal Abuses, and Trafficking in Persons<br><br> The Constitution and the law prohibit discrimination on the basis of race, gender, and other grounds; however, the government did not enforce these provisions effectively, in part due to the continuing absence of an effective judicial system. Violence against women and children, gender-based discrimination, trafficking in persons, and harassment and discrimination against ethnic minorities and homosexuals, and a rise in xenophobic violence were problems.

Other Societal Abuses and Discrimination<br><br> Both civil law and Shari'a criminalize homosexual activity, and Islamic religious law holds the death penalty as punishment for individuals who engage in consensual homosexual activities. During the year there were reports that the government deported and sentenced to prison individuals for being openly homosexual. Crossdressing, according to the law, is a punishable offence. On February 3, Dubai police called several men and women to be interrogated for crossdressing in public during a sports celebration parade. On July 14, three citizen men gang-raped a 15-year-old Swiss-French boy. The authorities initially did not disclose that one of the men was hepatitis and HIV-positive and threatened to charge the victim with homosexual acts when he first reported the rape. The victim left the country before any criminal prosecution. Authorities sentenced on December 12 two of the men to 15 years in jail, and the third defendant, a 17-year-old, (prosecuted at Juvenile Court) awaited his sentence at year's end.

A formação dessas gangues não tem uma definição clara. Algumas, usam as páginas do site de relacionamentos Orkut na Internet para defender suas déias ou incitar a violência. Pregam o anti-semitismo, patriotismo, e outros que propõem violência contra nordestinos, negros, prostitutas e gays.

?O mais revoltante é que esses jovens agiram de caso pensado. Eram rapazes brancos, de classe média, bem vestidos e que se expressavam bem. Tinham entre 20 e 30 anos, aparentemente e não pareciam ser lutadores. Mas tinham um discurso extremamente homofóbico?, contou o funcionário público, que assustado, disse nunca ter passado por situação semelhante.

O presidente da Associação do Orgulho GLBT (Gays, Lésbicas, Bissexuais e Transgêneros) de São Paulo foi espancado na tarde desta segunda-feira na sede da entidade, na praça da República, região central de São Paulo.<br><r> De acordo com Dimitri Sales, assessor jurídico da CADS (Coordenadoria de Assuntos de Diversidade Sexual) da prefeitura, Alexandre Peixe dos Santos estava na associação quando o local foi invadido. Ele foi agredido, amordaçado e encapuzado pelos criminosos.

O preconceito contra os homossexuais vem sendo tratado como assunto grave e passível de multa pelo Judiciário brasileiro. Em caso recente, a Secretaria da Justiça de São Paulo aplicou multa de R$ 14,8 mil à Associação dos Funcionários Públicos do Estado de São Paulo por suposta conduta homofóbica contra um servidor público, que pretende registrar seu companheiro como dependente na entidade. Essa decisão reflete a necessidade urgente de leis que tratem da concessão de direitos aos casais do mesmo sexo.<br><br> Prejudice against homosexuals is becoming a serious matter and possibly one of a fine by the Brazilian Judiciary. In a recent case, the Secretary of Justice of Sao Paulo gave a fine of R$ 14.8 thousand to the Association of Public Employees of the State of Sao Paulo for so-called homophobic conduct against a public servant, who tried to register his partner as a dependent in the entity. That decision reflects the urgent necessity of laws which deal with the granting of rights to same sex couples.

Um caso de homofobia envolvendo o jogador do São Paulo Futebol Clube Richarlyson virou manchete dos principais veículos de comunicação do país. O juiz da 9ª Vara Criminal de São Paulo, Manoel Maximiano Junqueira Filho, mandou arquivar o processo movido pelo jogador contra um dirigente do Palmeiras que, em um programa de televisão, insinuou que o atleta era homossexual. Em seu despacho, entre inúmeras declarações homofóbicas, o juiz afirmou que "não poderia jamais sonhar em vivenciar um homossexual jogando futebol".<br><br> O "caso Richarlyson" demonstra o grau de homofobia que assola nosso país. Mas o jogador tem demonstrado sua coragem e partiu para lutar pelos direitos constitucionalmente garantidos não só a ele como a todos nós, cidadãos, que são: honra, dignidade, igualdade e privacidade. Richarlyson poderia ter agido de três formas diferentes nesta situação: ter se recolhido e não levar a história adiante, agir por ele mesmo ou, e aí é que está o seu brilhantismo, lutar por todos nós.

One obstacle is that outside Guatemala City, free drugs are available at relatively few centers. "Most everything is centralized in this city," complains Eduardo Arathoon, who runs the Luis Angel García family clinic at Hospital San Juan de Dios in the capital. Arathoon points to an HIV-infected couple with their little girl. "The couple gets up at 3 a.m. and takes three buses to get here," he says. The centralization particularly hurts Mayans, who make up about half the population and often live in remote areas.<br><br> These problems will soon be compounded: MSF is leaving the country, which has Lucas and many other patients worrying about their futures once again.

According to Article 388 of the penal code (adopted June 8 1996) sodomy may be punished with imprisonment from two months to 2 years and a fine of 10,000 Algerian dinars.[1] According to Article 333, an "outrage to public decency" increases the penalties in the case of "acts against nature with a member of the same sex" with a prison sentence of between 6 months to 3 years and a fine of between 1,000 and 10,000 dinar
