Full text of new ruling Section 377 of the Indian Penal Code -The ruling was written by Chief Justice AJIT PRAKASH SHAH, 07/03/09 (Sexual Minorities & HIV Status)
"The criminalisation of homosexuality condemns in perpetuity a sizable
section of society and forces them to live their lives in the shadow of
harassment, exploitation, humiliation, cruel and degrading treatment at
the hands of the law enforcement machinery. The Government of India
estimates the MSM number at around 25 lacs. The number of lesbians and
transgenders is said to be several lacs as well. This vast majority
(borrowing the language of the South African Constitutional Court) is
denied "moral full citizenship". Section 377 IPC grossly violates their
right to privacy and liberty embodied in Article 21 insofar as it
criminalises consensual sexual acts between adults in private. These
fundamental rights had their roots deep in the struggle for independence
and, as pointed out by Granville Austin in "The Indian Constitution -
Cornerstone of A Nation", "they were included in the Constitution in the
hope and expectation that one day the tree of true liberty would bloom in
India". <br>

According to Amnesty International (AI), "LGBT [lesbian, gay, bisexual and transgender] people in El Salvador regularly face attacks and intimidation" (AI 7 Aug. 2006). AI indicates that between 2001 and 2006, the offices of the Entre Amigos Association, a Salvadorian gay advocacy group, were raided seven times and that all raids were reported to authorities but none resulted in prosecution (ibid.). The homosexual rights group Entre Amigos reported that public and private actors engaged in violence and discrimination against sexual minorities and persons with HIV/AIDS, including the government's continued denial of Entre Amigos' application for legal registration. Entre Amigos also reported that throughout the year, persons vandalized and robbed the group's offices, necessitating that the organization move locations regularly.
Lack of public information remained a problem in confronting discrimination against persons with HIV/AIDS or in assisting persons suffering from HIV/AIDS."

A national law does exist to prohibit discrimination on the basis of sexual orientation, but it is rarely enforced [4]. Polls show high levels of prejudice directed at LGBT, and many reports of anti-gay harassment and bias motivated violence [5].<br><br>
Much of the nation's advocacy on behalf of LGBT rights comes from William Hernandez and the other members of, "Asociacion Entre Amigos" (1994 Among Friends Association), who have faced harassment and even death threats for their activism [6]."
